1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia and New Zealand aged 18 years or over. Employees (and immediate families) of the Promoter, Are Direct (Australia and NZ), Are Media and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.
3. The promotion commences on 10 Jun 2024 and closes on 02 Jan 2025 at 23:59pm AEST (for online entries) or last mail received (for mail entries) at 17:00pm AEST on the same day (“Promotional Period”).
4. The Promoter’s decision is final and no correspondence will be entered into.
5. To be eligible to enter, individuals must purchase any Puzzler branded puzzle magazine that features the ‘Win an ASX’ promotion (“Participating Titles”) during the Promotional Period. For the sake of clarity, any Puzzler branded puzzle magazine that does not feature the ‘Win an ASX’ promotion will be deemed invalid for entry into this promotion.
6. To enter, individuals must then complete one (1) of the following entry methods during the Promotional Period:
a) Mail Entry: To enter via mail, individuals must, complete the “Prize Puzzle” in the Participating Title (purchased in accordance with clause 5 above), write the correct solution to that puzzle (“Prize Answer”) in the space provided on the official entry coupon (found within that Participating Title), complete the rest of the official coupon with all of the requested personal details (including their full name, mailing address, postcode, valid email address and daytime telephone number), and then send the fully completed entry coupon to “Puzzler Win an ASX GXX, GPO Box 590, Sydney, NSW 2001, AU” (for Australian residents) or to “Puzzler Win an ASX GXX, Private Bag 92-217, Auckland Mail Centre, Auckland, NZ” (for New Zealand residents) so that it is received during the Promotional Period;
OR
b) Online Entry: To enter online, individuals must complete the puzzle found on the entry coupon in the Participating Title (purchased in accordance with clause 5 above) then visit the promotional entry page at www.puzzler.com.au/competitions (in Australia) or www.puzzler.co.nz/competitions in (New Zealand), write the correct answer of the puzzle completed as prompted, and submit the online form with their personal details fully completed (including their full name, address, valid email address and daytime telephone number) so that it is received during the Promotional Period.
7. Maximum of two (2) entries are permitted per Participating Title/Issue purchased, subject to the following: (a) maximum of one (1) Online Entry permitted per Participating Title/Issue purchased; (b) maximum of one (1) Mail Entry permitted per Participating Title/Issue purchased; and (c) each entry must be submitted separately and in accordance with the entry instructions outlined above. Each mail entry must be posted in a separate stamped envelope and contain an official entry form with a correct Participating Title/Issue puzzle solution. For the sake of clarity, individuals are eligible to submit up to two (2) entries for each Participating Title/Issue purchased, however one (1) of those entries must be an Online Entry and the other must be a Mail Entry.
8. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
9. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Original copies of entries will not be returned to the entrant after the draw has been completed.
10. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid.
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. The draw will take place on 13 Jan 2025 at Direct Response Australia, Unit 19, 191 McCredie Rd, Smithfield NSW 2164 at 10:00am (AEST). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified in writing within two (2) business days of the draw and by telephone. Winners will be published online at www.puzzler.com.au and www.puzzler.co.nz on 20 Jan 2025. In the event of any SA winners, their names will be published in The Advertiser on 20 Jan 2025.
14. The first (1) valid and correct entry drawn from all entries received will win the following prize, as applicable to their country of residence:
Australian Residents: 2024 Mitsubishi ASX LS 2.0 petrol valued at up to AU$ 26,945.50 including ‘On Road Costs’ (on road costs vary dependent on State/Territory of residence).
New Zealand Resident: 2024 Mitsubishi ASX LS 2.0 petrol valued at up to AU$ 37,190.00 including ‘On Road Costs’ (on road costs may vary).
Total prize pool in Australia is valued at up to AU$ 26,990. Total prize pool in New Zealand is valued at up to NZ$ 37,190.00.
15. If necessary, an unclaimed prize draw may be held on 14 Apr 2025 at the same time and place as the original draw in order to distribute any unclaimed prizes, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and in writing within two (2) business days of the unclaimed prize draw. Winners’ names will be published online at www.puzzler.com.au and www.puzzler.co.nz from 21 Apr 2025. In the event of any SA winners, their names will be published in The Advertiser on 21 Apr 2025.
16. Prizes must be taken as offered. The prizes, or any unused portion of a prize, are not transferable or exchangeable for cash. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. All prizes must be taken as offered and are subject to individual store terms and conditions of use.
17. The Promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
18. The winner must have a current valid Australian or New Zealand driver’s license, as applicable. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
19. The vehicle prize excludes any optional extras. Subject to agreement by the supplying dealer, stock availability and subject to the winner agreeing to pay any additional amount requested by the dealer, the winner may upgrade the vehicle optional extras, and accessories. Except as expressly stated in these Terms and Conditions, the supplying dealer will not provide a substitute model. The supplying dealer will not exchange the vehicle for cash.
20. The Promoter takes no responsibility for any mechanical, body or paint repairs from the date and time of delivery.
21. Unless expressly stated within these Terms and Conditions, all expenses incurred in relation to the vehicle prize (including insurance) are the responsibility of the winner.
22. Prize values are correct at time of printing/submission; no responsibility is accepted for any variation in the value of the prize.
23. The prize supplier is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
24. The winner must provide all information and sign all documentation necessary to enable Mitsubishi Motors Australia/New Zealand Limited to register the prize in the winner's name prior to collection. Receipt of the prize is subject to the winner being able to lawfully take possession of the prize and comply with all registration and compulsory third-party insurance requirements of the State/Territory in which the winner elects to register the prize.
25. The winner of the prize must collect it from the nominated dealer and it must be registered prior to collection. Any number plate details used in the promotion of the competition are representational only. If the winner is unable to collect the vehicle, the winner may incur cost of transporting the vehicle, if needed, from their nearest dealership to an alternate prize claim point as nominated by the winner and deemed acceptable by the Promoter. Any costs associated with the transport of the vehicle to an alternate location will be the responsibility of the winner.
26. In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
27. It is a condition of winning that the prize winner provides the Promoter with their full name, address, license and a copy of their current Australian or New Zealand driver’s license (as applicable) prior to the awarding of the prize.
28. Prize is subject to the standard terms and conditions of Mitsubishi Motors Australia/New Zealand Limited.
29. Subject to the unclaimed prize draw clause, in the event that for any reason whatsoever the winner does not take the prize, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
30. In the event that the prize is unavailable, the Promoter reserves the right to substitute the prize, in its discretion, with an alternative prize to the same and equal recommended retail value and/or specification subject to any written directions from the various lottery departments.
31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize.
33. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
34. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
35. Any cost associated with accessing the promotional website or posting any entries via mail is the entrant’s responsibility and is dependent on the Internet service provider, mailing company used and postage option selected.
Privacy:
36. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The Promoter may also disclose PI to other third parties, who may send the entrant promotional and marketing communications, unless the entrant ticks the box on the entry form stating "Please do not provide information about me to any organisation not associated with this competition". Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.puzzler.com.au/legals/privacy-policy (for Australian residents) or www.puzzler.co.nz/legals/privacy-policy (for New Zealand residents). In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entries collected in Australia or New Zealand will not be disclosed overseas.
